South Africa’s Mining Bill Faces Industry Resistance

South Africa’s mining sector is bracing for impact as the proposed Mineral Resources Development Bill draws sharp criticism from the Minerals Council. The bill, intended to promote inclusive growth and tighten governance, has instead sparked fears of regulatory uncertainty and investment flight.
CEO Mzila Mthenjane emphasized that while transformation is essential, the bill must also foster predictability and competitiveness. “We need a regulatory environment that encourages exploration and sustains existing operations,” he said during a media briefing.
Key concerns include vague empowerment provisions, ministerial discretion, and the treatment of historical stockpiles. Ursula Brown, head of legal at the Council, noted that the lack of clarity around empowerment rules during the prospecting phase could hinder inclusive participation.
The Council, representing 90% of South Africa’s mineral output, submitted its critique before the August 13 deadline and continues to engage with the Department of Mineral Resources and Energy. The industry’s message is clear: reform must be pragmatic, not punitive.
